www.barerooms.com is owned and operated by BareRooms LTD, a company registered and existing under the laws of the United Kingdom.

Please read these Terms and Service and our Privacy Policy carefully before accessing or making use of our services. All users of our website and services are conditioned upon acceptance of these Terms of Service and our Privacy Policy. We may require you to accept further terms that apply to certain features or services.

By clicking to indicate your acceptance or otherwise further access or use of any part of our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you are not allowed to use our Services. Any new or updated features or tools that are added to the current website and our services shall also be subject to these Terms of Service.

Definitions

"Our website" or "this website" - refers to www.barerooms.com which includes: all pages, sub-pages, sub-domains, and any associated web-based application (collectively, "Website") owned and operated by BareRooms LTD.

"We", "Us", and "Our"- shall be used interchangeably and shall refer to BareRooms LTD, its owners, its affiliates and/or subsidiaries, and any person or entities associated with BareRooms LTD.

"Visitor"- is someone who merely browses this website but has not subscribed to our services.

"Member"- is someone who purchases a subscription to use our services

"User" or "Users" or "You"- is a collective identifier that refers to either a Visitor or Member.

“Services”- shall collectively mean our services, content, and our website.

“User Content”- collectively refers to all the data that users upload, transmit, create, or generate on or while using our Services. This includes all information a user sends to us.

Legal Compliance

By using our Services, you agree to comply with all applicable local and international laws, statutes, ordinances, and regulations. We reserve the right to investigate reported violations of any of our operational Terms and to take necessary action we deem appropriate, including but not limited to canceling Services we render you, reporting any suspected illicit activity to law enforcement bodies, regulators, or other third parties.

Changes To These Terms

We reserve the right, at our sole discretion and without prior notice, to make additions, modifications, remove, or change portions/all these Terms at any time. Users will be notified about any changes through the website. In addition, Members will be notified through a message sent to their associated account e-mail.

Changes will automatically be effective when posted unless we state otherwise. We urge Users to review the latest version of these Terms on this page any time they visit this website or make use of our Services. Your continued use of our Services without reading these Terms and their subsequent updates any time you use our Services means your acceptance of the latest version of these Terms.

In cases of disputes, the version of this Terms of Service at the time we receive your dispute notice will be applicable in resolving your dispute with us.

These Terms of Service and our Privacy Policy shall govern should any other policies of ours conflict with any provisions of these Terms and our Privacy Policy.

Starting Your Membership

Our joining process is an online process. Full membership prices and options can be found on our website (INSERT WEB ADDRESS), to be selected by you as part of the joining process. By completing the online joining process and becoming a Member of BareRooms Ltd, you are accepting all the terms and conditions in this Membership Agreement (insofar as they are applicable). You should only join if you have read and accepted them.
This Membership Agreement starts once you have accepted the terms during the online joining process. By accepting the terms, you are agreeing to pay any applicable Administration Fee, Membership Amount and Monthly Membership Amount. Subject in each case to any Promotional Rate that may be payable for a limited period only. These are shown at the start of the joining process and again before you confirm your payment instruction.
This Membership Agreement starts once you have accepted the terms during the online joining process. By accepting the terms, you are agreeing to pay any applicable Administration Fee, Membership Amount and Monthly Membership Amount. These are shown at the start of the joining process and again before you confirm your payment instruction.
You may choose during the online joining process to start your Membership either immediately or one month from the date that you accept the terms. We may inform you during the online joining process that a waiting list is in operation in which case your Membership starts when we inform you by email.
You agree to comply with the BareRoom Ltd Rules and you agree to use the gym facilities and equipment in the proper manner. You must consult a member of staff if you are unsure. We are not liable for any injury you suffer through the incorrect use of our equipment or facilities.
You confirm that you are at least 16 years old. Please note that you must provide on request valid proof of age if we believe you to be under the age of 16. If you are unable to provide valid proof of age on request your membership may be terminated.
You will be liable for any damage caused to our equipment or facilities through your negligent use.
You agree to tell us immediately of any changes to your personal details, including contact information; this should be done in the online Member Area

Membership Terms

£15.99 Monthly Membership – This membership package entitles a member to 4 hours usage of a room within a calendar month.
Two (2) to four (4) members can jointly book to use the multi room. Joint booking entitles all members of the group a total of 4 hours usage of the multi room within a calendar.
Additional hours can be purchased.
Room bookings must be made no less than 12 hours prior to visit
Booking cancellations require 24 hours’ notice or forfeit the hour (unless proof of exceptional circumstances can be provided).
Cancellation made by the member part way through the month will incur full month charge.
Hours are non-transferable, cannot be rolled over or exchanged for cash or credit.
Membership can be suspended at any time.
Children under 16 years of age can use the facilities under the supervision of an adult, up to a maximum of 2 children per adult member with full membership.
Guests are not permitted
Personal Trainers are permitted to work with a maximum of 4 members in the flexi room, with PT memberships.

Room Use

The use of our rooms and equipment is at the sole risk of the member. The member assumes all risk and liability for the use of the room.
Our rooms are specifically designed for virtual reality, golf, or weights. You are not allowed to use it for other activities.
We can make arrangements for additional equipment upon prior request.
A member must be medically, mentally, and physically fit to engage in activities within our facility. We recommend you seek medical advice before engaging in any activity within our facility.
It is the obligation of the member to leave the room orderly after each use, failure to comply will result in termination of membership with no refund.
All damage or breakages must be reported to the reception desk immediately.
Members are required to report any issue they notice in the room or with equipment before starting any activity.
Member hours or part thereof begin on the hour, unused time or late arrival cannot be credited.
The use of illegal drugs is strictly prohibited, members are not permitted to use the facilities if under the influence of alcohol.
All illegal activity will be reported to the police and membership withdrawn without recourse to reimbursement.
No smoking or vaping
Members are responsible for checking room equipment prior to commencing activity
The removal of equipment will incur additional charges and forfeit membership with immediate effect.

As a Member of BareRooms LTD you agree that you will

Clean equipment with the sanitiser spray and paper towels provided and replace the equipment back to the racks after use.
Use the cleaning products, including hand sanitiser as provided.
Wash your hands regularly with soap and water whilst on the premises.
Carry and use a sweat towel for personal use only and not to wipe equipment. Please use the dedicated cleaning stations for wiping down equipment after use.
For the general safety of others, if you are unwell, symptomatic or have tested positive for coronavirus, you are prohibited from coming to our premises. You must follow government regulation on isolating for a minimum period of time, and only return after this minimum period if you are free of such illness.
Use your unique Personal Identification Number (PIN) every time you enter and exit the gym.
Keep your PIN and member log in details a secret and it must not be disclosed to anyone else.
Complete your online induction if you are a wheelchair user or are under 18 years old.
Strongly consider completing the online induction, particularly if you are a first-time user.
Not take photographs or videos on the premises or post remarks or imagery to the internet that could identify another Member or a Member of Staff without prior permissions.
Not drop or throw weights down on the floor anywhere in the Weights room.
Not leave your belongings when you are not on the premises (we regularly remove items left and donate it to charity).
Wear suitable clothing and footwear when exercising (denim, bare feet, flip-flops, boots or a bare torso are amongst the range of clothing choices that is unsuitable). Any member not wearing suitable attire may be asked to leave the gym at the discretion of the local management team.
Use the facilities and equipment in a proper manner and not in a way that might cause harm to yourself or others (just ask a member of staff if you are unsure).
Not engage in any exercise activity that may be potentially harmful to you or others (this includes contact sports such as martial arts and boxing unless this is with one a Personal Trainers).
Not use, block or interfere with fire, emergency or disabled access doors or alarms (except in a genuine emergency).
Do not tamper with fire extinguishers.
Not behave in an aggressive, abusive, intimidating, anti-social or threatening manner or in a way that might cause distress to staff or Members.
Not discriminate, harass, or engage in unwanted physical or verbal contact with another member or member of staff.
Not conduct any Personal Training business with other Members without a PT membership.
Come and go quietly so as not to disturb our neighbors.
Use any parking facilities provided in accordance with the rules that the parking provider posts and may change from time to time (if you get a parking ticket, we are not liable).
Not park your bicycle in an unsafe or in an inappropriate location. Where possible use the bike racks provided.
Put your litter in the correct bin, let’s recycle where possible.
Not use the gym whilst under the influence of alcohol, narcotics, tranquilizers or make use of any other medical substance which may affect your ability to exercise safely on our premises. BareRooms reserves the right to remove you from the premises if it reasonably believes you are unfit to use the facilities.
Not engage in any type of criminal behavior whilst on our premises.
Not cause damage to the premises, our or another Member's property.
Not misuse the vending machines.
Not force entry to locked doors.
Not eat whilst in the rooms.
Leave the premises before closing time and promptly upon completion of your allocated time slot.

Ownership User Limited Licence

BareRooms and our related Services: All contents provided to you through our Services are owned and licensed to BareRooms LTD. Our contents and all associated Services are trademarked, copyrighted, and have obtained worldwide intellectual property rights. All rights are reserved. BareRooms, subject to your acceptance and abiding by these Terms, grants you a limited license to use our Services. You agree not to use our Services in any way that will tarnish our good public reputation or bring us any liability. We reserve the right to terminate, ban, and seek further legal actions against you if you breach any of these Terms.

YOUR ATTEMPT TO DISRUPT, MANIPULATE, HIJACK, HACK OR INTERFERE WITH THE SERVICES OR OPERATIONS OF BAREROOMS WILL BE CONSIDERED A BREACH OF OUR OPERATIONAL POLICY OR VIOLATION OF CRIMINAL AND CIVIL LAWS.

Content of Users: Our Services permit Users to create, share, and post content which includes but is not limited to messages, photos, videos, graphical works, etc. (All collectively referred to as "User Content") The User retains all rights to their User content except for (a) any content from the Services that may be incorporated in your User Content, and (b) the license you grant below, as between you and BareRooms.

The User hereby grants a non-exclusive, revocable, and limited license to BareRooms to use the content freely, reproduce, prepare derivatives, distribute, use for marketing and promotions worldwide without any royalty owed to the User. To the extent permitted by law, the User waives all rights to future claims of the content, content authorship, or rights to limit the usage of the content by BareRooms.

To post, transmit, upload, or publish any content on our Services, you agree that such content is:

Originally yours, not in violation of any third-party rights, or that you have obtained adequate right and license from the owner of the content before posting.
Authentic and accurate
Not in violation of any local, federal, or international law.
Not considered to be confidential.
Not prohibited or in violation of any section of our Terms of service
Free of malicious codes, worms, spyware, trojans, viruses, ransomware, adware, etc.

Availablity Of The Service: Warranty Disclaimer

Our Services may be temporarily unavailable from time to time for maintenance or other reasons. BareRooms assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, or communication failure. We reserve the right to suspend, withdraw, or restrict the availability of all or any part of our Services for business and operational reasons.

OUR SERVICES AND ALL CONTENT, MATERIALS, AND PRODUCTS ARE PROVIDED ON AN “AS IS" BASIS, WITH ALL "DEFECTS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. BAREROOMS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF TITLE, NON-INFRINGEMENT, AND IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, ACCURACY OF INFORMATIONAL CONTENT, AND ANY WARRANTIES ARISING OUT OF ANY USE OF OUR PRODUCTS AND SERVICES. BAREROOMS MAKES NO REPRESENTATION THAT THE SITE, OUR MOBILE APP, OR ANY CONTENT IS FREE FROM ERRORS, VIRUSES, BUGS, OR OTHER HARMFUL COMPONENTS. BAREROOMS MAKES NO REPRESENTATION OR WARRANTY THAT CONTENT PROVIDED THROUGH OUR SERVICE IS APPLICABLE OR APPROPRIATE FOR USE IN YOUR STATE OR COUNTRY.

BY USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU DO SO AT YOUR OWN RISK.

Limitations: Waiver of Liability

IN NO EVENT WILL BAREROOMS OR ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PERSON FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, OR PUNITIVE DAMAGES, INCLUDING FOR ANY LOST PROFITS OR LOST DATA ARISING FROM YOUR USE OF OUR SERVICES, CONTENT, OR ANY RELATED PRODUCT ACCESSED THROUGH OUR SERVICES, EVEN IF BAREROOMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, BAREROOMS’S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION WILL AT ALL TIMES BE LIMITED TO THE AMOUNT A MEMBER PAID FOR OUR SERVICES.

Governing Law

These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by and construed by the laws of the United Kingdom.

Seperation of Terms

Each of the paragraphs of these Terms operates separately. If any part of these Terms is not enforceable, the rest of these Terms still apply and are binding, and any unenforceable term will be substituted with a term that comes as economically close to the unlawful or unenforceable term as possible.

Assignment

We reserve the right to assign our rights and obligations under these Terms to a different party or entity at any time without your consent. Users are not allowed to assign their rights or obligations under these Terms to any party without obtaining prior written consent from BareRooms, any attempt to do so without our consent is void.

Entire Agreement

These Terms, and any other policies or rules we reference in these Terms, make up the entire agreement between you and BareRooms relating to the subject matter of these Terms and supersede all prior understandings of the parties relating to the subject matter of these Terms, whether those prior understandings were electronic, oral or written, or whether established by custom, practice, policy or precedent, between you and us.

Language Of The Terms

Any translated version of these Terms of service is for informational use only. The translated version may not fully represent our position as it could mean something different from the English version. The English version remains the authentic version of these Terms.

No Waiver

Our non-enforcement of our rights under these Terms at any time does not mean we waived the right to do so in the future. And, if we do expressly waive a provision of these Terms, that does not mean we have waived it in perpetuity. If we do waive a default or breach by you, we will only do so in writing, and that will not mean that we will automatically waive any later default or breach by you.
